1. Acceptance of Terms
By accessing or using LeFast ("the Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all the terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who wish to access or use the Service. By creating an account, you represent that you are at least 18 years of age or the age of majority in your jurisdiction.
2. Description of Service
LeFast provides a WhatsApp Gateway API platform that enables businesses and developers to:
- Send and receive WhatsApp messages programmatically via REST API
- Manage multiple WhatsApp device connections
- Schedule and automate message broadcasts
- Configure auto-reply rules for incoming messages
- Access message delivery analytics and API usage logs
- Integrate webhooks for real-time message event notifications
The Service uses the Node.js Engine to manage WhatsApp Web sessions and processes messages through a queue-based system for reliable delivery.
3. Account Registration and Security
To access the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information
- Keep your API keys and password confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
You are solely responsible for maintaining the confidentiality of your API keys. LeFast cannot be held liable for any loss or damage arising from your failure to protect your API keys.
4. Subscription Plans and Billing
4.1 Plans
We offer the following subscription plans:
- Free Plan: Limited message quota and device count. No credit card required. Free plan never expires.
- Paid Plans (Monthly/Yearly): Increased message quotas, device limits, and rate limits. Billed in advance on a recurring basis.
4.2 Payments
All payments are processed securely through Midtrans, our third-party payment processor. By subscribing to a paid plan, you authorize us to charge your selected payment method on the agreed billing cycle.
- Payments are due at the start of each billing period
- All prices are listed in Indonesian Rupiah (IDR) and include applicable taxes (VAT/PPN)
- We accept payments via credit/debit card, bank transfer, and other methods supported by Midtrans
4.3 Renewal and Cancellation
Paid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time from your account dashboard. Upon cancellation:
- Access to paid features continues until the end of the current billing period
- No partial refunds are provided for unused time
- Your account will be downgraded to the Free plan after the current period ends
4.4 Upgrades and Downgrades
You may upgrade your plan at any time. Upgrades take effect immediately, and the price difference will be prorated. Downgrades are subject to the following:
- You cannot downgrade from a paid plan to a lower-tier paid plan or free plan while the subscription is active
- To downgrade, please cancel your current subscription first, then subscribe to a new plan after it expires
- Plan downgrades may result in reduced features, device limits, or message quotas
5. Acceptable Use Policy
You agree not to use the Service for any unlawful or prohibited activities, including but not limited to:
- Sending spam, unsolicited bulk messages, or phishing attempts
- Distributing malware, viruses, or other harmful code
- Harassing, abusing, or threatening individuals
- Impersonating any person or entity
- Violating WhatsApp's Terms of Service or applicable laws
- Interfering with or disrupting the integrity of the Service
- Attempting to gain unauthorized access to any system or account
- Using the Service to send illegal content, including but not limited to child exploitation material, hate speech, or fraudulent content
We reserve the right to suspend or terminate any account found to be in violation of this policy without notice.
6. Device Management and WhatsApp Compliance
LeFast connects to WhatsApp via the WhatsApp Web protocol. By using the Service, you acknowledge:
- You are responsible for complying with WhatsApp's Terms of Service
- WhatsApp may ban phone numbers that violate their terms (e.g., bulk messaging without opt-in)
- We are not responsible for WhatsApp account bans resulting from misuse of the Service
- We recommend using dedicated phone numbers for business messaging
- Device connections are maintained via a session-based system; disconnecting or expiring subscriptions will terminate active sessions
7. Rate Limits and Fair Use
To ensure service stability for all users, rate limits are enforced based on your subscription plan:
- Messages per second, minute, hour, and daily limits as specified in your plan
- API request rate limits
- Concurrent device connection limits
Exceeding these limits may result in temporary throttling or suspension of API access.
8. Data Ownership
You retain all ownership rights to the message content, recipient data, and any other information you process through the Service. We do not claim ownership over your data.
We reserve the right to use anonymized, aggregated usage data for service improvement and analytics purposes.
9. Service Availability and Support
We strive to maintain high availability of the Service, but we do not guarantee 100% uptime. The Service may be temporarily unavailable for:
- Scheduled maintenance (we will provide advance notice when possible)
- Emergency repairs or security updates
- Factors beyond our reasonable control (e.g., internet outages, DDoS attacks)
Technical support is provided via email for all plans. Priority support may be available for higher-tier plans.
10. Limitation of Liability
To the maximum extent permitted by applicable law, LeFast and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of profits, data, use, or goodwill
- Service interruption or computer damage
- Cost of procurement of substitute services
- Any damages arising from your use of or inability to use the Service
Our total liability for any claims under these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless LeFast, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:
- Your use of the Service in violation of these Terms
- Your violation of any third-party rights, including WhatsApp's Terms of Service
- Your violation of any applicable law or regulation
- Any content or data you submit, send, or process through the Service
12. Termination
We reserve the right to suspend or terminate your account at any time for any reason, including without limitation:
- Breach of these Terms
- Violation of applicable laws or regulations
- Suspected fraudulent or abusive activity
- Non-payment of fees
- Request by law enforcement or government agency
Upon termination, your right to use the Service will immediately cease. Your data may be deleted after a reasonable period. Provisions of these Terms that by their nature should survive termination shall survive.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. Material changes will be notified via:
- Email to the address associated with your account
- A notice on the Service dashboard
- Updating the "Last updated" date at the top of this page
Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising under these Terms shall be resolved in the courts of Indonesia.
